Terms of Service
These terms govern your use of outbids.app, the purchase of a public board position, and when money comes back.

Provider and scope
The board is operated by Sven Guettner, Walter-Hohmann-Str. 19, 45128 Essen, Germany (the provider, we, us). Contact: support@outbids.app. These terms apply to every visitor and to every submission, whether free or paid.

What the service is
outbids.app publishes a public ranking of submitted destinations ordered by verified bid total. The service consists of publishing your card at the position your verified total earns, tracking outbound clicks and displaying them publicly. Nothing else is promised. We do not sell traffic, impressions, leads, conversions, endorsement, editorial coverage or a guaranteed duration at any rank.

No account
There is no user account. Your destination is the identity of your listing. Whoever controls that destination is treated as the owner of the listing for corrections, removals and re-bids, and we may ask for proof of control before acting on a request.

Prices, tax and merchant of record
Prices are shown in US dollars. Bids are whole dollars and the minimum paid bid is $1. Checkout runs on Stripe with Managed Payments, which makes Stripe the merchant of record for your purchase: Stripe is your counterparty for the payment, determines and remits any applicable sales tax, VAT or GST, and issues your receipt. The price you enter is the total charged, with any tax contained in it. The tax actually applied depends on your location and is shown during checkout and on the receipt.

Contract formation
Submitting the form is an offer. For a free listing the contract is concluded when the listing is published after validation. For a paid position the contract is concluded when Stripe confirms the payment and the position is published. Until then no position is reserved and someone else can claim the same rank.

Immediate performance and withdrawal
A board position is a digital service that is performed immediately. By submitting a paid bid you expressly request that we begin performance at once and you acknowledge that you lose your statutory right of withdrawal once the position has been published in full.

Refunds before publication
If your payment has not yet published a position, write to support@outbids.app and we cancel it and refund in full. Nothing has been delivered at that point, so this costs you nothing.

Refunds after publication
A board position is delivered the moment it is published, which is why the statutory withdrawal right ends there, as set out in the section above. A published rank is therefore not generally refundable, and being passed by a higher bid is the normal working of the board rather than a defect.

When we refund
We refund if the position was never published although the payment cleared, if it was published incorrectly and could not be fixed, if you were charged twice for the same bid, or if we remove a rule compliant listing for our own reasons. In those cases the refund goes back to the original payment method.

When we do not refund
No refund is given where a listing is removed for breaking the rules, where the destination itself changed or went offline after publication, or where the outcome you hoped for did not happen. The board sells a position, not a result.

How to request a refund
Stripe is the merchant of record, so you can raise a refund with us at support@outbids.app or directly with Stripe support. Either route reaches the same decision. Include the destination and the approximate time of payment so it can be matched.
Because Stripe sells to you, Stripe also applies its own buyer protection: it may issue a refund within 60 days of purchase at its discretion, and it applies statutory cooling off rules where a jurisdiction requires them. A refund granted by Stripe removes the payment behind the position, so the listing total is recalculated and the rank drops accordingly.

Chargebacks
A chargeback on a published position leads to the listing being hidden while the case runs, because the payment behind the rank is no longer verified. Tell us first and we will usually resolve it faster than a card issuer can.

Your content and warranties
You warrant that you are entitled to submit the destination, that its content is lawful, and that it does not infringe third party rights. You grant us the right to display the destination, its publicly published title, description and preview image, and its normalised address on the board and in social previews, for as long as the listing is active.

Removal and refusal
We may refuse, hide, recategorise or delete a listing that breaks the rules or applicable law, at any time and without notice where the breach is serious. Where a paid listing is removed because it breaks the rules, the bid is not refunded and the rank is not preserved. Where we remove a compliant paid listing for our own reasons, we refund the amount paid for the unpublished remainder of that position.

Availability
The board is provided as is and as available. We aim for high availability but do not warrant uninterrupted operation. Maintenance, provider incidents and abuse mitigation can cause downtime. Downtime does not extend or refund a rank, because a rank is a position and not a period of time.

Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and where mandatory statutory liability applies. For slight negligence we are liable only for breach of a material contractual obligation, limited to the foreseeable damage typical for this type of contract, and capped at the amount you paid for the position concerned. We are not liable for the content, availability or conduct of third party destinations listed on the board.

Third party services
The board depends on Stripe for payments and Cloudflare for hosting and delivery. Their terms apply to their own services. An outage or decision at a provider is not a breach of these terms by us, and we will tell you what happened.

Changes to these terms
We may change these terms for future submissions. The version in force at the time of your submission governs that submission. Material changes are announced on this page with a new effective date.

Governing law and venue
German law applies. If you are a consumer, mandatory consumer protection rules of your country of habitual residence remain unaffected. For merchants the place of jurisdiction is Essen, Germany.

Severability
If a provision of these terms is or becomes invalid, the remaining provisions stay in force.
